Birth Registration for Vietnamese Children Born in Canada

A birth certificate is an important document for establishing nationality under the nationality laws of many countries. However, for a variety of reasons, many people never obtain Vietnamese nationality because their parents did not complete the statutory birth registration procedure. This results in the loss of rights and lawful interests that Vietnamese citizens are otherwise entitled to under the law — most notably, the right to hold land use rights in Vietnam and the right to travel to visit family in Vietnam using a Vietnamese passport.

The birth registration requirements below are set out separately for each of the following situations:

For Children Born in Canada with a Vietnamese Citizen Father or Mother

1. 1 Application for a Birth Certificate or Application for a Birth Certificate Extract
2. 1 notarized copy of the child's Certificate of Live Birth (with the original for comparison).
3. 1 notarized copy of the parents' Marriage Certificate (with the original for comparison).
4. 1 notarized copy of the passport of the child's father and mother (with the original for comparison).

Note: If the child's father (or mother) is currently living in Vietnam or in a third country, a supplementary declaration form for the father is also required, as prescribed for the entry relating to the father on the child's Birth Certificate.

If the child's father does not hold Vietnamese nationality, you must submit an additional Agreement on the Child's Nationality.

A declaration of paternal acknowledgment (if required)

For Persons Born and Registered in Vietnam Before January 1, 2016, Whose Civil Status Register and Original Civil Status Documents Have Been Lost, and Who Now Wish to Re-Register Their Birth

1. 1 Application for Birth Re-Registration, with 2 photographs attached (passport-style photos taken within the past month). Complete all sections of the application, and it must be signed by 2 witnesses.
2. 1 copy of a passport, National ID Card, Household Registration Book, or a valid substitute document such as a Record of Landing (with the original for comparison).
3. 2 powers of attorney for a representative (with the principal's signature certified and consularly legalized at the Vietnamese Embassy in Canada) to carry out the birth re-registration procedure at the original place of birth registration in Vietnam;

For Persons Born and Registered in Vietnam Who Wish to Obtain a Copy of Their Birth Certificate

1. 1 Application for a copy of a birth certificate, using the prescribed form
2. 2 powers of attorney for a representative to carry out the procedure for obtaining a copy of the Birth Certificate.
3. 1 copy of a passport and documents proving Vietnamese origin (such as a national ID card, citizen ID card, household registration book, etc.).

Note: Any documents in a foreign language included in the civil status registration file must be translated into Vietnamese or English as required.
